He said that the death penalty was &#8220;practically impossible to impose it but we have not formally held it to be unconstitutional.&#8221; He also said, &#8220;it wouldn&#8217;t surprise me if it did&#8221; fall. <\/p>\n<p>The Supreme Court has already heard two cases against the death penalty originating from Kansas and plans to hear one from Florida. It will then hear a case Foster V.
