guantanamoSeeking to make good on one of his main campaign promises, President-elect Barack Obama has been conferring with his transition team on how best to close the US’s Guantanamo Bay prison camp. Inheriting the legal entanglements of the previous administration’s internationally maligned facility, Obama’s advisers’ are cautioning that no concrete decisions have been made in drafting their plans. But, according to news reports, Obama and his transition team are considering the creation of a new hybrid justice system for prisoners currently held at Guantanamo who would face prosecution in the United States as opposed to those being repatriated or sent elsewhere after the facility closes. Meanwhile civil liberties and human rights groups are pressuring the incoming Obama administration to close Guantanamo and end military commissions on day one of his administration. The American Civil Liberties Union took out a full page advertisement in the New York Times saying, “Give us back the America we believe in,” and are working in collaboration with Brave New Foundation to run short videos on Guantanamo. The ACLU is reiterating its position that detainees should be prosecuted before a traditional U.S. criminal or military court without exception.

GUEST: Ben Wizner, Staff Attorney with the ACLU
