Is Net Neutrality Dead?
On Tuesday, the U.S. Court of Appeals for the District of Columbia struck a blow to the principle of Network Neutrality. The court overturned a Federal Communications Commission’s ruling against Comcast Corporation. Comcast had been required by the FCC to offer equal treatment to all Internet traffic flowing through its network. The original sanction came in 2008 when the FCC found that Comcast had blocked users from accessing BitTorrent technology used in file-sharing. Comcast lied about the practice when confronted by the FCC. The nation’s largest high-speed internet provider had also planned to cripple online video sites competing with its own on-demand service. Comcast challenged the FCC sanction in court and as Tuesday’s decision makes clear, the FCC’s ability to enforce network neutrality on all telecommunications companies is now under serious assault.
