California Gets Ready to Resume Executions
Governor Schwarzenegger yesterday delayed the execution of Albert Greenwood Brown for 45 hours. Unless he is granted clemency Brown is now set to die by lethal injection on Thursday, September 30, at 9:00pm. Brown’s execution will be the first in California in almost 5 years. He received the death penalty when he was convicted for the 1980 rape and murder of 15-year old Susan Jordan in Riverside. Brown was denied a stay of execution yesterday by a Marin County judge and was earlier denied a stay by US District Judge Jeremy Fogel, the same judge who issued the injunction that halted executions in California in 2006. Preceding that decision Judge Fogel heard four days of testimony regarding California’s lethal injection process and then ruled that inmates were at risk for feeling excruciating pain during an execution using a three-chemical mix. The first chemical was a paralytic, which rendered the person unable to move or cry out from the intense pain that the following two chemicals may cause. The San Francisco Chronicle reports that in his decision Judge Fogel said prison staff was not properly trained to administer the lethal injection, preparations procedures were unclear, and the death chamber was too dark to monitor the process. On Monday September 20th a state appeals court lifted the 5 year injunction and the state’s Attorney General’s office raced to set an execution date for Albert Brown. His lawyers have accused the Attorney General’s office, headed by Gubernatorial candidate Jerry Brown, of using the execution as a way to win support for the Democrat from pro-death penalty voters.
